EBEL, Circuit Judge.

The defendant-appellant Walter Ray Queen was indicted on 16 counts of mail and wire fraud, in violation of 18 U.S.C. §§ 1341 and 1343. He was charged with fraudulently obtaining money from investors by misrepresenting that he would invest their funds in precious metals and foreign currencies. Instead, it was charged, the defendant misappropriated the investors’ money and converted their funds for his own purposes. The defendant pled guilty to one count of mail fraud and was sentenced to 30 months in prison. On appeal, he argues that the district court improperly enhanced…
