These consolidated actions were brought to recover damages for a boy and his mother as a result of personal injuries sustained by the boy when he dived from a dock into shallow water at Lake Afton, a recreational area owned and maintained by Sedgwick county.

The actions were filed September 30, 1963. The defendant filed a motion to strike which was treated by the parties and the court as a demurrer to the two separate causes of action set forth in each of the petitions. (At times we will refer to these consolidated actions in the singular…
