DONAHUE, Circuit Judge.

On December 17, 1918, the Secretary of War, in pursuance of authority conferred by Act of Congress passed August 8, 1917 (40 Stat. 256, 258), caused proceedings to be instituted in the name of the United States for the acquirement by condemnation of lands, easements, and rights of way for the widening and straightening of the River Rouge, Mich. This act further provided that the United States should proceed with the work of widening and straightening this river channel, if local interests would provide the right of way and pay the damages awarded.
