Appeal by the defendant, Minsker Realty Company, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 28th day of December, 1914, denying its motion for a stay of all proceedings herein.

McLaughlin, J.:
The plaintiffs claim to have leased from the defendant for a term of five years certain premises in the city of ¡New York. In February, 1912, they brought an action in the Municipal Court of the City of ¡New York to recover $500 damages on the ground that the defendants had refused to let them into possession of the premises leased. The action was discontinued and judgment entered against plaintiffs for $30 costs.
