This case is before me for decision of the defendants’ motion to dismiss the complaint for failure to state a claim under Rule 12(b)(6), Federal Rules of Civil Procedure, and the plaintiffs’ motion for partial summary judgment pursuant to Rule 56., The complaint charges a violation of section 203(a) of the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. § 1053(a), arising from a provision in the company’s pension plan which authorizes a reduction of pension benefits paid to retired employees who recover workers’ compensation…
