This was an action in assumpsit on the common counts brought by appellee against appellant to recover a balance claimed to be due on account of commissions and money due appellee for advances paid to the use of appellant growing out of certain transactions in grain on the Board of Trade in Chicago. Appellant pleaded, first, the general issue; second, the statute of limitations, and third, that the consideration of appellee’s claims was the product of gambling transactions on the Board of Trade.
