Plaintiff Annie Marie Patrick was struggling to make her home mortgage payments after the death of her husband and the loss of his income. She contacted defendant CitiMortgage, Inc., and contracted to reduce her monthly mortgage payments under the Home Affordable Modification Program, a federal program designed to give relief to homeowners falling behind on their mortgage payments. 1 The Program did not subsidize home mortgages or give a private right of action under federal law.
