OPINION

HERLANDS, District Judge:

The within motion for a preliminary injunction is granted. This opinion sets forth the findings of fact and conclusions of law which are the grounds of the Court’s action (Fed.R.Civ.P. 52(a)) and the reasons for the granting of the injunction pendente lite (Fed.R.Civ.P. 65(a) (2)).

The complaint pleads five causes of action. The plaintiff’s claims are based on five different “theories”: (1) violation of the Lanham Act, 15 U.S.C.A. § 1125; (2) violation of New York General Business Law, McKinney’s Consol.Laws, c. 20 § 368-d; (3) violation of New York Civil Rights…
