The plaintiff, a colored boy then about fifteen years of age, received an injury, in the year 1881, while attempting to alight from the passenger train of the defendant, in the night-time, at a coal chute near DeSoto station, in this state, which resulted in the amputation *206of both his legs. He brought the present action to recover damages for this injury, and recovered a verdict and judgment in the sum of fifteen hundred dollars, from which the defendant prosecutes this appeal.
