This is an action brought by W. H. Turner against Webster G. Binninger to quiet title to 320 acres of land in Goshen County, Wyoming, described as the W/2 of the SW/4, the SE/4 of the SW/4, Section 20; The N/2 of the N/2, and the SW/4 of the NW/4 of Section 26, T. 26, R. 61. The plaintiif, in his petition, claimed to be the owner and in possession of the premises. He alleged that Binninger holds a mortgage of $1500 given by Caroline Duckworth, now Buck; that the mortgage is barred by the statutes of limitation.
