FREEDMAN, District Judge.

This case is a class action, brought by and on behalf of the tenants of Boston’s 15 major low-income housing projects, seeking a judicial order compelling the United States Department of Housing and Urban Development (HUD) and the Boston Housing Authority (BHA) to upgrade the quality of the living conditions in the Boston projects. The complaint alleges that HUD and the BHA have consistently failed in their duty to maintain the projects in a “decent, safe, and sanitary condition.” This alleged failure to act relates to two separate forms of agency inaction and…
