In Land O’Lakes, Inc. v. United-Buckingham Freight Lines, Inc., 351 F.Supp. 102 (D.Minn.1972), this court stated the facts of this controversy in some detail and held that the defendant motor carriers must refund an as yet undetermined amount of excess freight charges exacted from the plaintiff Land O’Lakes in connection with certain freight shipments.1 The refunds in question when finally determined as to amount are to be ordered as a result of an Interstate Commerce Commission (ICC) proceeding.
