I. Background

On April 1, 2006, Wolverine, Proctor & Schwartz LLC (the “Debtor”) commenced proceedings under Chapter 7 of the Bankruptcy Code in the United States Bankruptcy Court for the District of Massachusetts. On March 30, 2008 the Debtor’s Chapter 7 Trustee, Lynne F. Riley (the “Trustee”), commenced an adversary proceeding by filing a complaint seeking damages from Deepak S.
