suit was brought by G. C. Gifford & Company, against the Wharton Oil & Cotton Company, a corporation, and H. J. Bolton to recover the balance due on promissory notes executed by the corporation upon which Bolton was a surety. The corporation was alleged to be insolvent and was made a party defendant for formal purposes only. Bolton’s suretyship was alleged to be for only a proportionate amount of the balance due, and judgment was sought against him for that sum and his proportion of ten percent attorney’s fees on the face of the note as stipulated in the body of that…
