MEMORANDUM

WOODLOCK, District Judge.

This diversity action is brought against Sentry Insurance, A Mutual Company (“Sentry”), by Barbara Milazzo, a passenger seriously injured in a 1977 automobile accident. Sentry was the liability insurer of Marianne Kane, the owner and driver of the car in which Ms. Milazzo was injured.

Ms. Milazzo seeks damages under the Massachusetts Consumer Protection Act, Mass.Gen.L. ch. 93A, and Mass.Gen.L. ch. 176D for Sentry’s alleged wrongful refusal to settle her claims and to defend its insured, Ms. Kane’s estate, in the underlying tort action that was brought by Ms.…
