Spruance, J.:
This action was brought to recover money paid by the plaintiff to the defendant for taxes in excess, as the plaintiff claims, of the amount for which he was lawfully liable.
The case was heard by the Court below upon a case stated, and judgment was rendered against the plaintiff for costs of suit.
