Plaintiffs Gary and Bonita Forst (“the Forsts”) bring this products liability and personal injury action against Defendant Smithkline Beecham Corporation d/b/a GlaxoSmithKline (“GSK”), the manufacturer of the drug Paxil CR® (“Paxil”). Their claims arise from Gary Forst’s attempted suicide after beginning use of the prescription antidepressant. GSK has filed a motion seeking summary judgment based on federal preemption of the Forsts’ state law tort claims. For the reasons set forth below, the court will deny the motion.
