In this construction proceeding the executors seek a determination as to the meaning, validity and effect of subdivision (b) of the fourth article of the will. The single issue litigated may be briefly stated as follows: The testator made a specific bequest of certain shares of stock. These shares were not owned by him in legal title but were held in the name of a personal holding company of which he owned at the time of its incorporation one hundred per cent of the stock. At the time of the execution of the will he owned approximately ninety-three per cent of the holding company…
