OPINION

MARTINEZ, Justice.

The defendant was found guilty of four counts of murder on September 27, 1968 and on September 30, 1968 was sentenced to death by lethal gas. Pursuant to §§ 40A-29-2.1 through 2.3 N.M.S.A. 1953 Comp. (2d Repl. Vol. 6, 1972) the New Mexico Supreme Court issued a Mandate to the District Court of Grant County on September 30, 1969 for resentencing. The defendant was then sentenced to life imprisonment on four counts. On May 18, 1970 the New Mexico Supreme Court affirmed his four convictions on appeal filed October 10, 1968. State v.
