This is an action for contribution. The statement of claim discloses these facts:

On July 30, 1930, the plaintiff issued a policy of liability insurance to Claverie’s Pharmacy (hereinafter called the assured), in Asheville, N. C., upon a Harley-Davidson motorcycle, model 29 — J, serial No. 12666, to cover the legal responsibility of the assured for personal injuries and death to others as specified therein.
