The facts upon which the questions of law arise in this case are these: Prior to the 9th day of July, 1880, the plaintiff, B. Goldman, and Gustav Jordens were ■engaged as partners in manufacturing and dealing in shoes .and slippers in Milwaukee, under the firm name of B. Goldman & Co. On that day the defendant, as marshal, levied upon the entire stock of goods, material, tools, and machinery ■of the firm, by virtue of executions issued on judgments recovered against the copartners in the United States circuit ■court.
