This is an action, under the statute, to recover damages for tbe killing of Henry P. Koenig, deceased, by tbe neglect and default of tbe officers of tbe town, and by the insufficiency and want of repairs of a certain bridge therein. Tbe main facts may be briefly stated^ substantially as follows:

Tbe bridge in question was over tbe Trempealeau river, between East and West Arcadia, in the town of Arcadia, about 134 feet long, ten or eleven feet wide, of single track, and covered by two layers of three-inch plank, — tbe lower crosswise, and tbe upper lengthwise; and near tbe north end there was a…
