I. INTRODUCTION

After suffering injuries in a motorcycle accident, Plaintiff-appellant James Anderson brought a purported class action against State Farm Mutual Automobile Insurance Co. asserting, inter alia, common law bad faith and violations of the Colorado Consumer Protection Act (“CCPA”), Colo.Rev.Stat. § 6-l-105(l)(e), (g), (u). Accepting the recommendation of the magistrate judge, the district court dismissed Anderson’s complaint under Fed.R.Civ.P. 12(b)(6) and entered judgment in favor of State Farm.
