Appeal by the plaintiff, William H. Shaffer, as administrator de bonis non of George A. Bartholick, deceased, from a judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of Monroe on the 26th day of February, 1898, upon the decision of the court rendered after a trial before the court without a jury at the Monroe Trial Term.

Adams, J.:
The plaintiff, as administrator de bonis non of George A. Bartholick, deceased, brings this action to recover of the defendants, *249who were partners in the practice of law at the city of Rochester, certain sums of money paid to them by one Charles Flaherty, as executor of the last will and testament of Bartholiek, in compensation for professional services rendered to Flaherty as executor, in a protracted litigation over the probate of the will under which he assumed to act.
