OPINION

This is an appeal from an order of the district court denying a petition requesting the removal of an administrator and the submission of a will to probate. Following appellant Lola Bynum’s presentation of evidence at the hearing in this matter, the district court orally granted respondent Jack Doyle’s motion for dismissal pursuant to NRCP 41(b).
