OPINION OF THE COURT BY

PERRY, J.

In this case the plaintiff claims the sum of five thousand dollars as damages for injuries suffered by him in consequence of the alleged negligence of the defendant while operating an automobile on Hotel Street in this city on October 21, 1909. The plaintiff at the time of the accident was Standing on the running board of an electric street-car and was thrown to the ground by the impact of the automobile which was going in the opposite direction.
