In August, 1927, Ernest Shaw commenced action to quiet title to certain lands in Chouteau county, as against McNamara & Marlow, Inc., a corporation, George Brundage, sheriff, and Steve Marcinko. McNamara & Marlow and Marcinko filed answers, setting up their claims to the property, and the latter filed a cross-complaint bringing in Harris P. Burke and his wife, Jane E. Burke, who answered the cross-complaint. Issue being joined, the cause was tried to the court sitting without a jury, and findings of fact and conclusions of law were made and filed by the court covering all of the issues…
