(after stating the facts). A preliminary question is made by the Baltimore and Ohio Railroad Company. Tt insists that the decree appealed from was not the final decree; that a final decree was pronounced June, 1890, and a supplemental decree *708June, 1893; that the appeal was from this last decree, and that the questions settled by the former decree of June, 1890, cannot be reviewed, because there was no appeal from it within the time allowed-by law.
