Financial Center, Inc. (FCI) filed a motion for rehearing in this case. See Tex. R.App. P. 49.1. In its motion, FCI contends that because this Court conducted a factual sufficiency review of the evidence, we should have reversed and remanded this matter to the trial court rather than reversing and rendering a judgment. FCI also contends that we erred in finding that TRST Corpus, Inc. (TRST) is a governmental unit and that FCI’s declaratory judgment action is barred by sovereign immunity.
