On November 26, 1887, the defendant, who was then the publisher of the Allegan Gazette, published in such newspaper the following article of and concerning the plaintiff, who was then marshal of the village of Allegan:

“While silent as the clam, he in several other respects resembles, as to the charges against Mr. Eppink, the editor of the Tribune undertakes a defense of Marshal Hay against the Gazette’s strictures concerning his course in the arrest of Ben Stearns. Truth is not desirable in the Tribune, as the organ of a ring that is a foe to all that is truthful and decent; hence it avers…
