ORDER DENYING IN PART AND GRANTING IN PART DEFENDANTS’ MOTION TO DISMISS

Before the court is the “Defendants’ Motion to Dismiss Plaintiffs Second Amended Complaint Pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6)” (Dkt. 41). For the following reasons, the Defendants’ motion is denied in part and granted in part.
