The plaintiff brought this action to recover damages for injuries to his person and property alleged to have been caused by the negligence of the defendant in driving his motor vehicle on the York road, a public highway in Montgomery county. The action was brought in Montgomery county, in which the damages were sustained; and the sheriff of that county deputized the sheriff of Philadelphia county, wherein the defendant resides, to serve the writ of summons, and the sheriff of the latter county made a return of service which is in all respects regular.
