On November 8, 1929, the plaintiff, Julia Orlosky, caused a summons in trespass to issue against Arthur J. Haskell, the defendant, in the Court of Common Pleas of Clearfield County. The summons was made returnable to the first Monday of December, 1929. With the praecipe, plaintiff filed a statement alleging that her husband, Jacob Orlosky, came to his death on May 6, 1929, as a result of injuries inflicted upon him May 5, 1929, by the negligent operation of an automobile driven by the defendant in the County of Clearfield.
