On November 7, 1976 the defendant-appellant CBS Inc. (CBS) telecast a show entitled "60 Minutes”, which was estimated to have been viewed by 24 million people. A portion of the program dealing with amphetamine abuse, entitled "Over the Speed Limit”, had been created and produced by defendant-appellant Grace Diekhaus. Defendant-appellant Mike Wallace served as the correspondent for this segment of the program.
