This was an action of assumpsit .instituted in the Circuit Court of Adams county by the defendant in error against William H. Forbes, Isaac Lum, and plaintiff in error, on a promissory note made by said Forbes and Lum for $12,544, dated tbe 29th of January, 1862, and payable twelve months after date to tbe order of said Forbes, who indorsed and delivered tbe same to Ira Carpenter, wbo indorsed tbe same as follows: “ Protest waived, and I bold myself liable as indorser. Jany. 30, ’63.”
