Defendant-appellant Commissioner of the Massachusetts Department of Environmental Protection (“MDEP”) appeals from the district court’s entry of summary judgment in favor of plaintiffs-appellees American Automobile Manufacturers Association, Association of International Automobile Manufacturers, Inc., and Massachusetts State Automobile Dealers Association, Inc.
