This was an action of assumpsit, brought by Dudley Sneed, against John Woolbright, for the price of a piano. Upon the trial, the plaintiff read in evidence the following letter from the defendant to the plaintiff.

Palmyra, Feb. 2&th, 1841.

» Mr. D. Sneed. — I have concluded to take your piano forte, provided yoii will take Tyson’s note for three hundred dollars, which will be collected as soon as the law will collect it, or I will pay you three hundred dollars as soon as I can make it out of him by law.
