In a proceeding pursuant to CFLR article 78 to review a determination of the Zoning Board of Appeals of the Village of Irvington, dated June 23, 2009, which, after a hearing, confirmed the Village Building Inspector’s denial of the petitioner’s application for a building permit, the petitioner ap*1239peals from a judgment of the Supreme Court, Westchester County (Cacace, J.), entered February 23, 2010, which denied the petition and, in effect, dismissed the proceeding.
Ordered that the judgment is affirmed, with costs.
