This is another Savings Bank deposit case, but it is unlike any of the numerous ones that have preceded it. The facts are few and simple. Elizabeth O’Neill, on the 24th day of April, eighteen hundred and ninety-five, opened an account in the Metropolitan Savings Bank. In the pass-book which she then received, the following entry appears : “ Metropolitan Savings Bank, in account with Miss Elizabeth O’Neill. In trust for herself and Mrs. Mary Whalen, widow, joint owners, subject to the order of either ; the balance at the death of either to belong to the survivor.” This entry was made at the…
