Ducker, J.:

Action for the recovery of a commission for the sale of real estate. For convenience the parties will be referred to as they were designated in the court below. The case was tried by the court, which found that the defendant Mrs. C. E. Mack was the owner of the property, and that defendant C. E. Mack, representing himself as her agent, employed the plaintiff to secure a purchaser for said property and agreed to give him as his commission for making such sale the sum of $1,000.
