This appeal arises from an order of the District Court for the Thirteenth Judicial District, Yellowstone County, granting respondents’ motion for a directed verdict following presentation of appellant’s case in chief. We affirm.

Appellant Clarence Wiberg filed suit on April 24, 1986, seeking rescission of contract, damages for breach of the implied covenant of good faith and fair dealing, punitive damages and specific performance of an alleged oral partnership agreement.
