OPINION AND ORDER REGARDING DEFENDANTS’ MOTIONS FOR SUMMARY JUDGMENT

I. Introduction

This case brought pursuant to the Railway Labor Act (“RLA”), 45 U.S.C. § 151 et seq., is presently before the Court on separate Motions for Summary Judgment filed by Defendants Transportation Communications International Union (“TCU”) and Consolidated Rail Corporation (“Conrail”). 1 The Court held a hearing on Defendants’ Motions on October 15, 1998.
