1Opinion of the CourtMcKENNA, Circuit Judge
(orally). This is a. suit to restrain the issuance of bonds under an ordinance of the city of Nevada, which is claimed to be illegal. The ordinance was passed to provide for the erection and maintenance of waterworks, the ordinary expenditures of the city authorized by its charter not being sufficient for that purpose. The city of Nevada was incorporated prior to the adoption of the “New Constitution,” so called. The ordinance complained of was passed under an act of the legislature of this state, with reference to- which the following language is contained in the bill:
