Appellants, Mark Greer and J. G. Burnside, filed a complaint in the circuit court of Fayette county against the Carter Oil Company and C. R. Bennett, for partition and removal of clouds upon 144 acres of land. The issue involved is the validity of a certain oil and gas lease to the Carter Oil Company and a mineral deed to C. R. Bennett, there being no controversy about the right to partition the surface of the land.
