Appeal by the defendant from a judgment of the Supreme Court, Richmond County (Rienzi, J), rendered January 30, 2007, convicting her of assault in the second degree, upon her plea of guilty, and imposing sentence. By decision and order dated March 31, 2009, this Court remitted the matter to the Supreme Court, Richmond County, to hear and report on the issue of whether the defendant was competent at her plea allocution and sentencing, and the appeal was held in abeyance in the interim (see People v Jefferson, 60 AD3d 1085 [2009]).
