MEMORANDUM OPINION

ROY, District Judge.

Pending before the Court are motions for summary judgment filed by defendants Missouri Pacific Railroad Company (“MoPac”) and International Brotherhood of Firemen and Oilers, AFL-CIO, Local 718 (“IBFO”). The defendants assert that they are entitled to judgment as a matter of law because there are no remaining issues of material fact.

The facts as set forth below are undisputed.
