The petitioner applied for a peremptory mandamus order “ directing the said respondents, constituting the Board of Elections of the City of New York, to forthwith comply with the provisions of section 243 of the Election Law and adopt for use at elections in the city of New York any kind of voting machine approved by the State Board of Voting Machine Commissioners or the use of which has been specifically authorized by law.” Mr. Justice Lazansky at Special Term (N.
