The plaintiff, claiming to be the owner of two policies of life insurance issued by the Northwestern Mutual Life Insurance Company upon the life of her husband, Harry B. Grems, seeks by this action to restrain his trustee in bankruptcy from collecting or enforcing the same and also asks a decree adjudging her to be the owner of said policies of insurance.

*646The policies in question were issued and held by the parties under the following circumstances:

In the year 1893 the husband was at work in a store in Rochester and, a child having been born to them, he signed an application for life insurance…
