JOHNSON, Judge.

Appellant was found guilty by a jury of second degree burglary under an indictment returned by the Grand Jury of Houston County, Alabama. He was sentenced to a term of three years in the penitentiary as punishment therefor. From this judgment and sentence, appellant takes this appeal.

The State’s first witness, Henry C. Butler, testified that on or about October 8, 1966, he operated the Woodside Lounge on Highway 92 in Houston County, Alabama; that on that date he closed said business around midnight; that he did not return until about 8:00 or 8:30 on Monday morning, October 10,…
