—Appeal by the People from an order of the Supreme Court, Nassau County (Ort, J.), dated June 3, 1997, which denied their motion pursuant to CPL 440.40 to set aside the sentence imposed upon the defendant on April 29, 1997, of one to three years imprisonment as unauthorized by law.
Ordered that the order is reversed, on the law, the motion is granted, the defendant’s sentence is vacated, and the matter is remitted to the Supreme Court, Nassau County, for further proceedings in accordance herewith.
